Convicted for Cannabis possession or use in South Africa? You may qualify to expunge your record. 

Cannabis for Private Purposes Act, 2024, there are several circumstances under which a person's criminal record can be expunged:

1. Automatic expungement: For individuals convicted of using or possessing cannabis under specific laws (Section 5(1)(a)), their criminal records should be expunged automatically by the Criminal Record Centre of the South African Police Service. No timeframe is specified for this automatic process.
2. Expungement upon application: If the automatic expungement hasn't occurred, individuals can apply for expungement in writing to the Director-General. This applies to: a) Those convicted of using or possessing cannabis (Section 5(1)(b)) b) Those convicted of dealing in cannabis based on certain legal presumptions (Section 5(2)(a))
3. Expungement for minors: Individuals whose details appear in the diversion record administered by the Director-General: Social Development for cannabis-related offenses can apply to have that record expunged (Section 5(2)(d)).
