Cannabis for Private Purposes Act, 2024, there are several circumstances under which a person's criminal record can be expunged:

  1. Automatic expungement: For individuals convicted of using or possessing cannabis under specific laws (Section 5(1)(a)), their criminal records should be expunged automatically by the Criminal Record Centre of the South African Police Service.   2. Expungement upon application: If the automatic expungement hasn't occurred, individuals can apply for expungement in writing to the Director-General.   3. Expungement for minors: Individuals whose details appear in the diversion record administered by the Director-General: Social Development for cannabis-related offenses can apply to have that record expunged (Section 5(2)(d)).
